Terms and conditions

These Terms and Conditions (“Terms”) govern your use of the MSTOO website, mobile applications and related services (together, the “Platform”). MSTOO is a marketplace that connects people who want to list items or services for rent with people who want to hire them.

By creating an account, posting an ad, placing a booking, or otherwise using MSTOO, you agree to these Terms. If you do not agree, please do not use the Platform.

1. Who we are

MSTOO operates an online rental marketplace in India. We are not the owner of items listed by users unless a listing clearly says otherwise. Contracts for a rental are between the listing owner (the “Provider”) and the person who books (the “Customer”). MSTOO provides the Platform, payments facilitation, messaging and related tools.

2. Eligibility and accounts

  • You must be at least 18 years old and capable of entering a binding contract under Indian law.
  • You are responsible for the accuracy of your profile, phone number, email and addresses.
  • Keep your login details confidential. Activity on your account is treated as yours.
  • We may suspend or close accounts that are inaccurate, abusive, fraudulent or that violate these Terms.

3. Location and service zones

MSTOO shows ads, categories and providers for the service zone that matches your selected location. Some areas may not be live yet. You can change location from the header. Listings, prices, availability and delivery or pickup options can differ by zone.

4. Posting ads

  • You may post ads only for items or services you are legally allowed to rent.
  • Listings must be truthful: photos, description, price, deposit, availability and location should match what you will actually provide.
  • You must not list illegal, stolen, counterfeit, hazardous, adult, weapons-related or otherwise prohibited goods or services.
  • MSTOO may edit, hide or remove ads that break these rules or community standards.
  • Featured or promoted placements, where offered, are paid extras and are described on the Refund page.

5. Bookings

When a Customer books a listing, they request the Provider to supply the item or service for the selected dates, time and address (as applicable). A booking is confirmed according to the status shown in the app or website (for example pending, accepted, ongoing or completed).

  • Customers must provide a reachable phone number and a correct service address.
  • Providers must honour accepted bookings or cancel in line with the Cancellation Policy.
  • Deposits, extra charges or damage fees, if any, must be disclosed in the listing or booking summary before payment.

6. Payments

Payments on MSTOO may be collected through Razorpay, wallet balance, loyalty points (where enabled) or other methods shown at checkout. Prices are displayed in Indian Rupees (INR). Applicable taxes, if any, are shown in the booking or payment summary.

MSTOO may hold, settle or refund amounts according to booking status, cancellation rules and payment-partner timelines. You authorise us and our payment partners to process charges on the method you select.

7. Chat, reviews and conduct

Use chat only for genuine booking and listing communication. Do not harass, spam, or share illegal content. Reviews must be honest and based on an actual transaction. We may remove content and restrict accounts that misuse the Platform.

8. Wallet, points and Pro

Wallet credits, loyalty points and MSTOO Pro (or similar subscription features), where enabled in your zone, are Platform benefits. They have no cash value except as described in-product, are non-transferable, and may expire or change when the feature is updated.

9. Intellectual property

MSTOO name, logo, design and software belong to MSTOO or its licensors. You keep rights in content you upload, and you grant MSTOO a licence to host, display and promote that content on the Platform so we can operate the marketplace.

10. Disclaimers

Listings are created by users. MSTOO does not guarantee the quality, safety, legality, availability or condition of any rented item or service, or the identity or conduct of any user. Use the Platform at your own risk and inspect items at handover where practical.

The Platform is provided “as is”. We do not warrant uninterrupted or error-free availability.

11. Liability

To the maximum extent permitted by Indian law, MSTOO is not liable for indirect, incidental or consequential losses, lost profits, or disputes solely between Customer and Provider. Our aggregate liability for a claim relating to the Platform is limited to the fees you paid MSTOO for the relevant transaction in the three months before the claim, or INR 5,000, whichever is higher, except where liability cannot be limited by law (including for fraud or proven wilful misconduct).

12. Indemnity

You agree to indemnify MSTOO against claims arising from your listings, bookings, content, misuse of the Platform, or breach of these Terms or applicable law.

13. Changes and termination

We may update these Terms. Continued use after an update means you accept the revised Terms. The current version is always published on this page. We may stop offering all or part of the Platform with reasonable notice where practical.

14. Governing law

These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction, subject to any mandatory consumer-protection rights that apply to you.
